Thanks for using Casapro App. Casapro App is an online home furnishing and building materials mall provided by Casapro North California Inc. (hereinafter called “We”, “Us, Our or Casapro”). Our registration address is 2225 GRANT AVE SAN LORENZO, CA 94580. We are committed to protecting and respecting your privacy. In this regard, we develop this Privacy Policy (hereinafter “this Privacy Policy or “this Policy) in accordance with the California Consumer Protection Act (“CCPA”) and other applicable laws and regulations to explain how we collect, use, disclose, transfer and store your Personal Information when you use our Casapro App (hereinafter “APP”). Before using Casapro and submitting your Personal Information, please read the Privacy Policy together with our User Agreement carefully to understand our approach to customer privacy and make choices that you deem appropriate.

This Privacy Policy is only applicable to our users living in the United States and only to the Personal Information collected by Casapro. This Policy does not apply to Casapro’s job applicant-related and employment-related records, and not applicable to your interactions with third parties or their websites or application.

1. Definitions

Affiliated Company refers to a company that is related to Casapro due to joint ownership or control.

“Third Parties” refer to companies or persons who do not have a related relationship arising out of joint ownership or control with Casapro (i.e., a non-Affiliated Company) or other non-related persons. Third parties can be financial or non-financial companies, or persons other than you and Casapro.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Sensitive Personal Information means Personal Information that reveals (a) a consumer’s social security, driver’s license, state identification card, or passport number; (b) a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) a consumer’s precise geolocation; (d) a consumer’s racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication; (f) a consumers genetic data; and (g) other categories of information stipulated by applicable laws and regulations.

“Processingrefers to any operation or set of operations which is performed on Personal Information or on sets of Personal Information, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

“Collect” refers to buying, renting, gathering, obtaining, receiving, or accessing any personal information pertaining to a consumer by any means. This includes receiving information from the consumer, either actively or passively, or by observing the consumers behavior.

Sell refers to selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for monetary or other valuable consideration.

“Delete” refers to the behavior of removing Personal Information from the system involved in the implementation of daily business functions, so that it cannot be retrieved and accessed.

“Publicly Disclose” refers to the behavior of releasing information to the society or to non-specific groups of people.

“Share” refers to the process of Personal Information controller providing Personal Information to other controllers, and both sides have independent control over Personal Information.

“Minor” refers to an individual who is under the age of 18 pursuant to “Privacy Rights for California Minors in the Digital World” in California Code.

1. How We Collect and Use Your Personal Information

We collect Personal Information for more efficient operations and provides you with the best product experience. The Personal Information we collect depends on the environment in which you interact with Casapro, the choices you make, including your privacy settings and the functions you use.

a. Personal Information That We Collect

i. Personal Information we collect directly from you

a) Contact and Account Information. When you register an account and order products on our APP, we will collect your name, e-mail address, telephone number, mailing and billing address.

b) Geolocation Information. When you browse and order product on our APP, we will collect your geolocation information including precise information and imprecise information. We will provide your precise geographical location information to third parties, such as logistics service providers to deliver products and payment processors to assist payment relevant matters.

c) Communication Information. When you upload a profile picture communicate with us through customer service or otherwise make inquiries, we will collect your uploaded photo and the data you provide in the communications with us.

d) Information You Post. When you post content on our APP, we will collect survey responses, participation in promotions, and other user-generated content, including but not limited to, images you upload.

e) Customer Service Information. For support or product issues, you may provide us with product or injury information. We do not collect your injury information without your consent or unless you provide it to us voluntarily.

f) Tax-related Information. If you are a B2B customer, we will collect your entity identification number or your VAT registration number, to prepare your Form 1099 and other tax-related documentation to verify your business and to provide you with tax compliant invoices.

ii. Personal Information proactively collected by us during your use of the services

a) Device Information. When you download and use our APP, we will collect online identifiers, IP address, device ID, operating system, type device that you are using, links clicked, and other analytics data.

b) Online Activity Information. When you search, browse, and purchase the products we present on our APP, we will collect your browsing history, search history, saved items, cart items and purchase history.

iii. Personal Information we collect about you from third parties

a) Social Media Profile Information. When you use other social media account to log in our APP or connect our APP account to other social media, we will collect your social media profile information publicly available on your social media account, such as your Google, Apple ID, Facebook, X or Instagram profile description.

b) Payment Information. When you make a purchase on our APP, we will use third-party payment processors, such as Stripe and PayPal, to process your payments. These third parties will collect the information necessary to effectuate your transaction with us, such as account information, credit/debit card number, payment information, security/CVV code, and expiration date. Our payment processors may handle your payment information in accordance with their own privacy policies. We do not have access to your full payment information, and we only collect truncated payment information from the payment processors.

iv. Additional Information for California Residents

Subject to the requirement of CCPA, the status of Personal Information collection and disclosure in the preceding 12 months is specified as below:

H. Audio, electronic, visual, and similar information, such as images and audio, video or call recordings created in connection with our business activities.

I. Professional or employment-related information, such as job title as well as employment record and working experience.

J. Education information subject to the federal Family Educational Rights and Privacy Act, such as student profiles.

K. Inferences drawn from any of the Personal Information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

Please note that we did not sell (as defined by the CCPA) any of your Personal Information.

b. How We Use your Personal Information

We use personal information for the following purposes or as otherwise described at the time of collection:

c) Providing and supporting our services. We use Personal Information to operate, maintain, and provide you with services of our APP. In particular, we will use Personal Information to perform our contractual obligation under our user agreement, such as to allow you to create an account and make purchases, facilitate financing solutions, and for us to take payment, deliver your purchases, and process returns.

d) Communicate with you about our Services. It is in our legitimate business interests to use Personal Information to respond to your requests, provide customer support, and communicate with you about our services, including by sending announcements, updates, security alerts, and support and administrative messages.

e) Improve, monitor, personalize, and protect our APP. It is in our legitimate business interests to improve and keep our APP safe for our users, which includes:

Ÿ Understanding your needs and interests and personalizing your experience with the services and our communications.

Ÿ Troubleshooting, testing, and research, and keeping the services secure.

Ÿ Investigating and protecting against fraudulent, harmful, unauthorized, or illegal activity.

2. How We Disclose Your Personal Information

We disclose Personal Information to the following categories of recipients:

· Affiliated company of Casapro, including parent company.

· Companies and individuals that help us deliver our products to you, including payment service providers (Srtipe, Paypal, etc.), logistics professionals, repair and assembly providers, and delivery and freight companies.

· Financing providers. By choosing to apply for a financing solution offered by a third-party financing provider, you direct us to disclose certain Personal Information to that provider to facilitate your application.

· Government and law enforcement agencies and private parties, as we believe in good faith to be necessary and appropriate to (i) comply with a legal process, subpoena, order, or other legal or regulatory requirement; (ii) enforce our terms of use or other policies; (iii) pursue available legal remedies or defend legal claims; or (iv) otherwise for the compliance and protection purposes described above.

· Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Casapro (including, in connection with a bankruptcy or similar proceedings).

3. How We Store Your Personal Information

Your Personal Information is stored in the United States cloud servers. We have entrusted well-known worldwide cloud storage service providers to store your Personal Information. We have entered into data processing agreements to ensure that appropriate technical and organizational measures are adopted to protect your rights and interests regarding Personal Information.

The retention period for your Personal Information is the minimum time necessary to achieve the collection purposes, except a longer period required by applicable laws and regulations or your explicit consent. We will delete Personal Information exceeding the above retention period upon expiration.

4. How We Protect Your Personal Information

We have taken safeguarding measures to protect the Personal Information you provided and prevent data from unauthorized access, publicly disclose, use, modification, damage or loss. In particular:

a. We adopt encryption measures such as TLS. We will ensure the channels and means of Personal Information transferred is strictly encrypted. We periodically review practices regarding data collection, storage and possessing (including physical security measures) to prevent your Personal Information from unauthorized access.

b. We use computer system that has limited access and merely allow our employees who need to know Personal Information in order to help us process it or authorized staff from service companies to access Personal Information. These people are required to comply with strict contractual confidentiality obligations. Failure to comply with the obligations will lead to legal liabilities or termination of contract.

However, please be attention, even if we undertake reasonable measures to protect your data, there is no website, internet transmission, computer system or wireless connection that are definitely safe. In case of Personal Information security incident where it is likely to result in a high risk to the rights and freedoms of you, we shall communicate the Personal Information breach to you in accordance with the requirements of laws and regulations such as basic situations and possible influence of the security incident, response measures we have taken or will take, suggestions for you regarding self-prevention and risk reduction, remedial measures for you, etc.

We will inform you in a timely manner by email, mail, telephone, push notification, etc., regarding the relevant situations of the incident. When it is difficult to notify each Personal Information subject individually, we will issue a notice in a reasonable and effective manner. In the meantime, we will take the initiative to report on the handling of Personal Information security incident in accordance with regulatory department’s requirements.

5. Your Privacy Rights

a. What Privacy Rights You Have

We respect your rights to Personal Information. Subject to the applicable laws and regulations, you enjoy the following legal privacy rights:

(1) Right to Know and Access: We publishes this Privacy Policy to inform you of how we handle your Personal Information. We are committed to the transparency of the use of your Personal Information. You are entitled to exercise your access right to visit data.

(2) Right of Rectification: If you find there is a mistake with your Personal Information we process, you are entitled to request us to correct inaccurate Personal Information. When your identity is confirmed, we will rectify accordingly.

(3) Right to Delete: You have the right to request us to delete certain Personal Information, subject to limitations, that we have collected from you. Please note, we may retain Personal Information when permitted by law such as but not limited to the following:

a) Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by the consumer within the context of our ongoing business relationship with the consumer, or otherwise perform a contract between the consumer and us.

b) Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.

c) Debug to identify and repair errors that impair existing intended functionality.

d) Comply with the any laws and regulations.

(4) Right to Opt Out of Sale and Sharing: We do not sell, share, and/or disclose your Personal Information to third parties for purposes unrelated to our retail products and services. You have the right to opt out of the sale or sharing of your personal information, but if the sharing relates to the performance of the contract between you and us, when you opt out, we may fail to provide relevant product and/or services.

(5) Right to Opt Out of Interest-Based Advertising and Other Targeted Advertising:  Currently, we do not use your Personal Information for interest-based advertising and other targeted advertising.  

(6) Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit our use and disclosure of your sensitive Personal Information. We use your sensitive Personal Information to perform the following:

a) to provide goods and services requested by you;

b) to prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidential of stored or transmitted personal information;

c) to ensure the safety of our customer.

Therefore, we do not collect or process Sensitive Personal Information for the purpose of inferring characteristics about individuals. To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

(7) Right to Appeal Your Request: You may appeal a decision taken by us not to take action on your privacy right request within a reasonable time after we renders a decision.

(8) Right to Refuse Automated Decision: You have rights not to be bound by automatic decisions, including user profiling. If these decisions will significantly affect your legitimate rights, you can refuse to be subject to automated decisions. We will respond to your request and take appropriate measures when necessary.

(9) Right to Complaint: You are entitled to file a complaint with the data protection authority of your state about our processing of your Personal Information.

(10) Right to Know Information Regarding Participation in Data Sharing for Financial Incentives: We will ask for your consent before collecting your Personal Information in connection with offering a financial incentive.

(11) Right to Nondiscrimination: You may always exercise all rights and we will not unlawfully discriminate against you for exercising your rights under the CCPA.

(12) California Residents Right Under the Shine Light Law: Residents of California also have the right to request information regarding third parties to whom we have disclosed certain categories of Personal Information during the preceding year for the third parties' direct marketing purposes. If you are a California resident and you wish to opt out, please send us an email at sales@casaprodesign.com.

b. How to Submit a Privacy Request

You can get in touch with us and assert your aforesaid right by sending email to sales@casaprodesign.com. Upon receipt of your email, we will respond and reply to you as soon as possible. Unless otherwise required by the laws of the state that you are located, generally, we will reply to you within 30 days upon receipt of your verifiable request (If necessary, we may extend it by an additional time as permitted by law. We will inform you the reason for the extension, such as the request is too complicated or too much in volume).

For security purposes, we will first verify the identity of each person who submits a privacy request. To verify your identity, we may require you to provide some information such as your first name, last name, city, state, email address and telephone number. We will use this information to search our database and determine what information we have collected about you.

If you are an authorized agent, you are not only required to submit your own first name, last name, address, city, state, email address, telephone number but also to submit the above information of your guest on behalf.

If you are not satisfied with the response you received, you can get in touch with us and/or refer the complaint to the relevant regulatory authority in your jurisdiction.

6. How We Process Minor’s Personal Information

The product and/or services of us are not minor-oriented, so we do not collect minor’s Personal Information. Nevertheless, we highly care about minor’s Personal Information protection. If you are a minor’s parent or guardian, and you reasonably believe that we have collected your minor’s Personal Information, please feel free to contact us via the contact details we disclose in the Privacy Policy and show initial evidence or materials to us. If we find that a minor’s Personal Information is collected, we will endeavor to delete relevant data immediately.

7. How Your Personal Information Transferred Globally

We provide products and relevant services through resources and servers in the United States. Your information may be accessed by our affiliated companies in other countries for the necessary purpose of Casapro Products maintenance.

8. How This Privacy Policy is Updated

We reserve the right to update or modify this Privacy Policy from time to time. We will send you update notices through different channels. For significant changes to this Policy, if you provide us your email address, we will send notifications to you before such changes take effect, nonetheless we will post the updated privacy policy on our APP. This Privacy Policy allows adjustments, but we will not diminish your rights under this Policy without your express consent.

We also keep on file the previous version of the Privacy Policy for your reference. The previous privacy policy may be obtained by contacting us in the method described in Section 10 of the Privacy Policy.

Please read the updated Privacy Policy carefully. If you don't agree to the Privacy Policy, or any amendment or update to the Privacy Policy, you may choose to stop using our APP. However, please be aware that this Privacy Policy will still govern your activities before you stop using the APP.

Significant changes in the Privacy Policy include but are not limited to:

(1) Our service model has changed substantially. For example, the purpose of processing Personal Information, type of Personal Information processed and method of using Personal Information, etc.

(2) We have material changes in the ownership structure and organizational structure. For example, change in ownership due to business adjustment, bankruptcy, merger and acquisition, etc.

(3) Your rights to participate in the processing of Personal Information and the method of exercising them have changed substantially.

(4) When there is any change in the department responsible for Personal Information security, contact information or the channels of making complaints.

(5) When the Personal Information security impact assessment indicates a high risk.
